I wish to share with you that I've made an offer to the City Manager's Office this afternoon in regards to the new "Broadcasting Policy".

WITHOUT PREJUDICE

In the alternative to further action, I'm offering the following settlement to this dispute regarding Charter Rights at City Hall and the City's new "Broadcast Policy ,

As stated by the City Solicitor publicly on Wednesday, the City has yet to create definitions in the policy.

My offer is as follows:

1) The City creates definitions in the policy;

2) The City issues an apology for acting without clear definitions of what constituted a violation of the new policy;

3) The City, for the purposes of this policy, adopts the definition of the Broadcasting Act which is:

"broadcasting means any transmission of programs, whether or not encrypted, by radio waves or other means of telecommunication for reception by the public by means of broadcasting receiving apparatus, but does not include any such transmission of programs that is made solely for performance or display in a public place;"

And:

"program means sounds or visual images, or a combination of sounds and visual images, that are intended to inform, enlighten or entertain, but does not include visual images, whether or not combined with sounds, that consist predominantly of alphanumeric text;"

4) The City adds language stating the public is allowed to use electronic devices for non-broadcasting as defined in the policy.
